NO, a notary public CANNOT tell whether you need an Acknowledgement or a Jurat.


Notaries are not allowed to provide legal advice or make decisions about what type of notarization is required. Their role is to follow your instructions based on the document's needs, not to interpret or choose for you.

An Acknowledgement is a type of notarization where the notary public verifies the identity of the signer and confirms that the signer willingly signed the document.


A Jurat is a type of notarization where the signer swears or affirms that the content of the document is true.


The key requirement for a jurat is that the document must be signed in the presence of the notary, and the notary administers an oath or affirmation to the signer.


Acknowledgement:  Confirms your identity and willingness to sign.


Jurat:  Requires you to swears or affirms to the truthfulness of the document and sign in the presence of the notary.

NO, the notarization cannot be fully completed if only one signer is present when the document requires two signers.


All signers must personally appear before the notary at the time of notarization, as the notary needs to verify each signer's identity and witness their signature.

The average notarization takes about 15-30 minutes, depending on the number of documents and signers involved.


In California, notarizing a document follows these steps:

  1. Bring the Document: Ensure the document is complete (Notary Public CANNOT perform notarization on a document that is not completed or has blank sections) but unsigned when you present it to the notary. You will sign it in their presence.
  2. Verify Identity: California law requires you to present an acceptable form on ID, such as a current-issued photo ID (e.g., Driver's License, Passport) The notary will verify your identity before proceeding.
  3. Complete the Notarial Certificate: In California, each notarized document must include a notarial certificate, either a Jurat (for oaths or affirmations) or an Acknowledgement (for affirming identity). The notary will complete this section; however, you must tell the notary whether you need an Acknowledgement or a Jurat (notary public CANNOT tell whether you need an Acknowledgement or a Jurat.  Notaries are not allowed to provide legal advice or make decisions about what type of notarization is required. Their role is to follow your instructions based on the document's needs, not to interpret or choose for you).
  4. Sign the Document: You will sign the document in the notary's presence to ensure the signature is genuine and made willingly.
  5. Notarization: Notary will complete the notarization form and sign.
  6. Journal Entry: The notary will make an entry in their notarial journal, which includes details like the date, your name, your address, address where notarization took place, your ID number and expiration, type of document and notarization, and your signature and thumbprint.
  7. Thumbprint (for each notarized document): Law requires you to leave a thumbprint in the notary's journal for each notarized document.
  8. Payment: Payment is required before the notary applies their official seal (notaries usually collect fees for their services upfront).
  9. Notarial Seal: Once payment is made, notary will proceed to finalize the process by affixing their notarial seal to the document, certifying that they verified your identity and witnessed the signing, completing the notarization process.
